2. Nature of our services
AffyAssess
AffyAssess is a bank statement analysis platform. It extracts data from consumer bank statements and produces affordability assessments, income verification, expense categorisation, category spend indicators, and statement deviation analysis. Outcome signals (Clear, Caution, or Review) are applied under rules selected and configured by the subscribing credit provider.
AffyAssess does not make credit decisions. It does not approve, decline, or recommend any lending action. It does not constitute an affordability assessment under the National Credit Act. We surface data from the statement; the credit provider interprets that data under its own rules. The output is one input among many that a qualified human decision-maker at the subscribing credit provider must consider before taking any credit action.
AffyAssess is not a credit bureau and does not compile or maintain an ongoing database of consumer credit records as contemplated by Section 43 of the National Credit Act.
3. Subscriber obligations
If you subscribe to any of our services as a credit provider, accountant, or other professional user, you agree that:
- You are solely responsible for all decisions made using our output, including credit decisions and lending actions
- You will ensure a qualified person reviews all automated output before taking action, in compliance with POPIA Section 71
- You have obtained all necessary consents and lawful grounds to share personal information with us for processing
- You will not use our output as the sole basis for any decision that produces legal effects for a consumer
- You will comply with all applicable laws, including the National Credit Act, the Protection of Personal Information Act, and the Financial Advisory and Intermediary Services Act
4. Consumer self-upload
Where a consumer uploads a bank statement via a tokenised self-upload link:
- The consumer will be presented with a consent notice identifying the credit provider and the purpose of the upload before any data is submitted
- Consent is explicit and may be withdrawn at any time by contacting us
- The consumer may request access to or deletion of their data (see our Privacy Policy)
5. Self-serve trial accounts
Anyone who meets our eligibility requirement (a credit provider, accountant, or other professional user) can create a free trial account at app.affy.co.za/signup. Trial accounts are evaluation accounts and are separate from our contracted partner accounts.
- Free credits. Each new account receives 3 free assessment credits (1 credit = 1 assessment) and may upload up to 10 documents in total. No card is required to sign up.
- Verified sign-up. Your account is only created once you confirm your email address via the link we send you.
- 30-day deletion. The account and all data uploaded to it, including the bank statements and the data extracted from them, are deleted 30 days after sign-up.
- Authorisation to upload. You must be authorised to process any bank statement you upload. You must not upload statements you have no right to process.
AffyAssess remains a pre-screening tool when used through a trial account. It is not a credit bureau and does not make credit or lending decisions (see Nature of our services above). The pricing, prepaid-credit, refund, cooling-off, VAT and eligibility terms in these terms continue to apply to any credits purchased beyond the free trial.
6. Pricing and payment
AffyAssess is priced per extraction on a prepaid basis. Current pricing is published in the Pricing section at affy.co.za. All prices are in South African Rand and exclude VAT unless stated otherwise.
We reserve the right to change pricing with 30 days' written notice. Prepaid credits already purchased will be honoured at the rate at which they were bought.
7. Refunds and cancellations
This section sets out when payments to us are refundable and how to cancel. It applies to all purchases made through our website, payment links, or invoices, including payments processed by our payment provider, Paystack.
Prepaid credits
- Used credits are not refundable. A credit is consumed when an extraction is run. At that point the service has been delivered.
- Unused credits are refundable. You may request a refund of unused prepaid credits at any time, at the price you paid for them. Request in writing to [email protected].
- If you purchased credits in error, or were charged twice for the same purchase, we will refund the incorrect payment in full.
Subscriptions and recurring billing
Where any of our services are billed on a recurring basis, you may cancel at any time by written notice to [email protected] or through your account. Cancellation takes effect at the end of the current billing period. You retain access until then. We do not refund the unexpired portion of a billing period already paid, except where required by law.
Cooling-off period
If you are a consumer as defined in the Electronic Communications and Transactions Act 25 of 2002, you may cancel an electronic transaction with us within seven (7) days of concluding it, without reason or penalty, and we will refund you in full within thirty (30) days. This right does not apply to services you have already begun using with your consent, such as credits consumed before cancellation.
How refunds are paid
- Refund requests are acknowledged within five (5) business days.
- Approved refunds are processed within ten (10) business days of approval, to the original payment method.
- Once processed, banks and card networks typically take a further 3 to 10 working days to reflect the funds.
- Refunds of duplicate or incorrect charges, and refunds under the cooling-off right above, are always paid in full. For other refunds we may deduct non-recoverable third-party payment processing fees from the refund amount.
Cancelling your account
You may stop using our services and close your account at any time by written notice. On closure, unused prepaid credits are refunded as set out above. If we terminate your access for breach of these terms, refunds of unused credits are handled as set out in the Suspension and termination section below.
8. Intellectual property
All intellectual property in our analysis engine, algorithms, software, website content, and output formats belongs to Momo Global. Subscribing to our service grants you a limited, non-exclusive, non-transferable licence to use our output for your internal business purposes only.
You may not reverse-engineer, decompile, or attempt to extract the source code or algorithms of any of our services.
9. Accuracy and warranties
We take reasonable steps to ensure the accuracy of our extraction and analysis processes. However:
- Our services are provided "as is" without warranty of any kind, whether express or implied
- We do not warrant that our output is error-free, complete, or suitable for any particular purpose
- Bank statement quality and formatting variations affect extraction accuracy
- Statement deviation indicators are advisory. They flag departures from the expected format, structure, or internal consistency of the issuing bank's statements for human review, and never auto-decline an application
10. Limitation of liability
To the maximum extent permitted by South African law:
- Our total liability to you for any claims arising from or related to our services is limited to the fees you have paid to us in the twelve (12) months preceding the claim
- We are not liable for any indirect, consequential, special, or punitive damages, including loss of profit, loss of business, or loss of opportunity
- We are not liable for any credit decision, lending outcome, or regulatory consequence arising from the use of our output
Nothing in these terms excludes liability for fraud, gross negligence, or wilful misconduct.
11. Indemnification
You agree to indemnify and hold harmless Momo Global, its directors, employees, and agents against any claims, losses, or damages arising from:
- Your use of our output in making credit or business decisions
- Claims by consumers or regulators related to lending decisions you have made
- Your failure to obtain proper consent before submitting personal information to us
- Your breach of these terms or any applicable law
12. Suspension and termination
We may suspend or terminate your access to our services if:
- You breach these terms
- We reasonably believe your use poses a risk to consumer rights, data security, or our reputation
- Required by law or regulation
Unused prepaid credits will be refunded at the price paid, as set out in the Refunds and cancellations section. Where termination is due to your breach, we may deduct amounts you owe us or losses directly caused by the breach before refunding the balance.
13. Governing law and jurisdiction
These terms are governed by the laws of the Republic of South Africa. Any dispute will be subject to the exclusive jurisdiction of the courts of Gauteng.
14. Changes to these terms
We may update these terms from time to time. Material changes will be posted on this page with an updated date. Continued use of our services after changes constitutes acceptance.
